Court Grants Firm Foreclosure Order Over N150m Unpaid Loan

LAGOS, Nigeria — An Ikeja High Court has granted a foreclosure order to Citygate Global Investment Limited, permitting the firm to sell a property pledged as collateral following a default on an outstanding loan of N150 million.

The court’s decision allows the lending firm to recover the debt by enforcing the sale of the property, which was used as security for the loan agreement. Details of the property and the identity of the borrower were not disclosed in court filings.

A foreclosure order is a legal remedy that enables a lender to take possession of or sell property that was offered as collateral when a borrower defaults on a loan. Under Nigerian law, lenders typically apply to the High Court for an order to sell mortgaged property through public auction, with proceeds used to satisfy the outstanding debt.

Citygate Global Investment Limited is a microfinance institution registered with the Corporate Affairs Commission of Nigeria. According to publicly available records, the company was founded in 2007 and is a registered member of the Association of Non-Bank Microfinance Institutions of Nigeria. The firm is also registered as an overseas company in the United Kingdom, where it has maintained an establishment since January 2023.

Legal experts note that foreclosure proceedings in Nigeria follow established judicial procedures, with courts assessing the validity of the loan agreement, the default status, and the lender’s compliance with statutory requirements before granting enforcement orders. Borrowers are typically afforded an opportunity to contest the application or redeem the property by settling the outstanding debt within a specified timeframe.

The Ikeja High Court, where the judgment was delivered, operates within a division of the Lagos State judiciary. The court complex has faced years of infrastructural neglect, including roof leaks, broken tiles, and erratic power supply that have affected its operations and the working conditions of judicial officers and court users.

The N150 million foreclosure order is the latest in a series of debt recovery actions by financial institutions in Nigeria, where rising default rates have prompted increased enforcement of loan agreements secured by real estate and other assets. The Economic and Financial Crimes Commission has also intensified investigations into loan default cases, while courts continue to handle foreclosure petitions from banks and mortgage lenders.

Citygate Global Investment Limited has yet to issue an official statement regarding the court order or the property subject to the foreclosure action. The company has not disclosed the identity of the borrower or confirmed whether the property has been scheduled for auction.
