The Department of State Services (DSS) has directed its counsel, Akinlolu Kehinde, SAN, to seek an adjournment of the alleged cyber-bullying case against African Action Congress (AAC) presidential candidate, Omoyele Sowore, until after the January 16, 2027 presidential election.
The case was filed after Sowore described President Bola Tinubu as a “criminal” in posts on his X and Facebook accounts in August 2025.
According to the DSS, the case seeks judicial interpretation on whether it is lawful to publicly describe the President or any individual as a criminal without a court conviction.
A source close to the DSS legal team said the agency’s Director-General, Tosin Ajayi, met with senior legal officers on August 20 and directed that an adjournment be sought to allow Sowore to fully participate in the presidential election without the case serving as a hindrance.
The source said the DSS believes that, since the matter has already been in court for nearly a year, postponing it for a few more months would not significantly affect the case.
The agency is expected to formally approach the Federal High Court for the adjournment when the court resumes after its annual judicial vacation.
Kehinde, SAN, confirmed the development, describing it as part of the DSS leadership’s effort to ensure a level playing field and allow all candidates to participate freely in the electoral process.
The DSS is also reportedly reviewing other cases involving candidates ahead of the 2027 elections.
