Obey Supreme Court judgment, stay away from APGA Secretariat, Court orders Victor Oye

News Band is in possession of the Certified True Copy (CTC) of the Judgment Order made on 6th June, 2023, by Justice Mohammed A. Madugu of the High Court of the Federal Capital Territory, holden at Bwari, Abuja, in suit no: FCT/HC/CV/4068/2023.

The suit was between Otunba Camaru Lateef Ogidan and Alhaji Rabiu Mustapha, the Plaintiffs, and, Chief Victor Ikechukwu Oye and the Independent National Electoral Commission (INEC), the Respondents..

In the Judgment Order, Justice Madugu warned the former National Chairman of the All Progressives Grand Alliance (APGA) to obey the judgment of the Supreme Court made on the 14th October, 2021, and corrected on the 24th March, 2023, and stay away from the party’s Secretariat.

The judge made the judgment order after reading the Originating Summons, the accompanying affidavit of Otunba Camaru Lateef Ogidan, Chief Godwin Udu’s counter affidavit and written address, and upon hearing Micheal Ajara, counsel to the Plaintiffs, and Dr. Obinna Onya, counsel to Victor Oye.

Justice Madugu ruled, amongst other things, that Victor Oye’s refusal to obey and comply with the subsisting judgments of the Supreme Court made on the 14th October, 2021, and corrected on the 24th March, 2023, is tantamount to disobedience of the judgments and orders of the Supreme Court.

The also held that the actions of Oye posing and parading himself and occupying the party’s secretariat as the National Chairman of APGA is contrary to the judgment and order of the Supreme Court, hence disobedience and in clear violation of the Supreme Court judgments.

He, therefore, issued an order of injunction restraining INEC and/or its agents, privies, assigns, authorized representatives or whosoever described from accepting, recognizing and dealing with Victor Oye.

The judge further ordered INEC and Victor Oye to comply with the Supreme Court’s decision made on the 14th October, 2021, and subsequently corrected on the 24th March, 2023.

Consequently, the court declared that all the actions taken, or to be taken, by Oye as the Chairman of APGA and INEC regarding congresses, conventions, primaries, meetings or flags off campaign of any kind whatsoever in disregard and disobedience to the Judgment of the Supreme Court are unlawful, illegal, null, void and of no effect whatsoever.

News Band had reported on June 6 how the FCT High Court in Bwari had sacked Barr. Sly Ezeokenwa Jr., who Victor Oye had appointed as a substitute, as the National Chairman of APGA.

According to the report, in the judgement, Justice Madugu nullified all actions taken by Victor Oye since the Supreme Court’s judgement that deleted his name from the annals of APGA.

Following the deletion, the apex court has replaced Oye’s name with that of Chief Edozie Njoku, who it affirmed as the authentic National Chairman of APGA.

The court ordered that all actions of Oye are unlawful, hence null and avoid.

It further ordered INEC to recognize Chief Njoku as the National Chairman of APGA in line with the Supreme Court judgement of March 24.
