EKITI: NSCIA responds to recent developments on Shari’ah Panel

The Nigerian Supreme Council for Islamic Affairs (NSCIA), Ekiti State Council, expresses disappointment over recent actions.

Certain state authorities and traditional institutions have made statements regarding the Independent Shari’ah Arbitration Panel.

Inaugurated on October 26, 2024, this panel aims to address civil disputes among consenting Muslims.

Legality of the Independent Shari’ah Arbitration Panel

The Independent Shari’ah Arbitration Panel is rooted in Nigeria’s constitutional provisions.

Specifically, Section 38 of the 1999 Constitution guarantees fundamental rights, including freedom of thought and religion.

Additionally, Section 6 allows for arbitration panels to resolve civil matters outside conventional courts.

Consequently, the Panel operates strictly within these constitutional boundaries.

It solely addresses civil and marital disputes among consenting Muslims.

Importantly, it does not exercise jurisdiction over penal cases or issues outside Islamic personal law.

Participation in the Panel is entirely voluntary, ensuring no individual or group is compelled to engage.

Clarification on the Role and Operations of the Panel

We categorically dispel any misrepresentation of the Panel as a punitive body.

Instead, it serves Muslims seeking resolution according to Shari’ah principles.

This practice is widely recognized in multi-religious societies and has been successfully implemented in various states.

Moreover, the Panel operates peacefully and transparently.

It aims to foster harmony rather than create religious disharmony or infringe upon non-Muslims’ rights.

This mechanism is designed for Muslims seeking justice in personal law matters, especially family and marital issues.

## Rejection of the Directive by the Ewi-in-Council

While respecting Ekiti State’s traditional institutions, we must reject the Ewi-in-Council’s directive to disband the Panel.

This directive represents a gross overreach, infringing upon Muslims’ constitutional rights.

The Ewi-in-Council lacks the legal authority to disband a lawful arbitration panel established under Nigerian law.

The Shari’ah Arbitration Panel serves as a tool for fostering peace and justice, not division.

Addressing the Statement by the Commissioner of Justice

We express concern regarding the Ekiti State Commissioner of Justice’s statement denying the Panel’s existence.

This position contradicts principles of justice and inclusion. The Commissioner’s remarks undermine trust between the government and citizens.

We encourage the Attorney General to engage constructively with the Muslim community.

Understanding the Panel’s purpose and operations will help dispel unwarranted fears and misconceptions.
