S’Court indefinitely adjourn Ekwunife’s case seeking revalidation

Supreme Court adjourned indefinitely the appeal filed by Ekwunife seeking the revalidation of her mandate which was annulled by the Enugu Appeal Court.

The Supreme Court Abuja has adjourned indefinitely the appeal filed by Ekwunife seeking the revalidation of her mandate which was annulled by the Enugu Appeal Court.

According to Elombah.com correspondent, the Lordships almost struck the case out if not for the gallant defense of Ekwunife’s lawyer, Alex Izion [SAN] who put up an intelligent objection before the court.

It was noted by our correspondent that his defence saved the situation.

The justices wanted to strike the case out on the grounds that the apex court does not entertain cases that never originated from trial courts.

However, with the brilliant disposition of Ekwunife’s counsel, the Lordships adjourned the hearing indefinitely.

They asked that proceedings from the high court or tribunal should be transmitted to them before any further hearing date can be announced.

Commenting on the ruling, a political pundit [names withheld] opined that “for the Apex Court to ask for the ruling of the tribunal or High Court to be transmitted to it means that they would like to see it in black and white.

“How Justice Yahaya-led three man panel of judges went off board and annulled the primaries of Sen. Ekwunife against the provisions of the Electoral Act which stipulated that an APGA candidate does not have the Locus Standi to challenge the primaries of a PDP candidate!”

It would be recalled that Justice Yahaya had in December 2015, annulled the elections of Senator Uche Ekwunife based on faulty primaries and asked that a re-run be conducted in 90 days.
