Agbaso Heads To Appeal Court, As Battle Shifts To INEC

It is judicial rascality, abuse of court process, legal embarrassment for state high court to sit as an Appeal in cases already at Appellate Courts.

The National Leadership of APGA led by Ochudo Martin Agbaso met at Abuja yesterday after the rulings of both Awka and Nnewi High Courts.

The meeting presided over by the Appeal Court recognised National Chairman of APGA, Ochudo Martin Agbaso said it will appeal the two rulings while continuing its preparations for the party’s primary election next month.

The Awka and Nnewi High Courts’ rulings, which favoured Oye, have further created confusion, panic and uncertainty in APGA.

The Appeal Court Enugu validated the order of mandamus recognising Agbaso as the only chairman of APGA when it threw away the stay of execution filed by Oye.

Everyone is now looking at how INEC will handle the legal quagmire in APGA.

The Awka High Court sat on a case that’s pending at Appeal Court Abuja which was adjourned to December 14, 2017, while the Nnewi High Court sat on another case pending at Enugu Appeal Court that was adjourned indefinitely.

The case at the Appeal Court Abuja, bothers on suspension of Oye by members of the NWC on October 5, 2016 while that of Enugu Appeal Court bothers on the legality or otherwise of Agbaso chairmanship.

The ruling of Enugu Appeal Court affirms Agbaso as the National Chairman of APGA. 

It therefore becomes judicial rascality, abuse of court processes and legal embarrassment for a state high court to sit as an Appeal in these cases that are already at the Appellate Courts.

The courts are already on their vacation, so the battle has shifted to INEC, and all eyes are on the electoral umpire to do the needful.
