Anambra Central Jan 13 Rerun: INEC Warned To Stay Off Election Over Pending Cases

Independent National Electoral Commission [INEC] was warned to stay off Anambra Election pending the determination of the outstanding 6 cases. 

The Independent National Electoral Commission [INEC] has been warned to stay off Anambra Central Senatorial Election pending the determination of the outstanding 6 cases. 

INEC had, in statement, fixed the date of the rerun election for January 13, 2018.

See the letter signed by one Mrs onyinyechi Okeke:

I write to respectfully bring to your attention, the pendency of the under listed referenced matter and other pending lawsuits in which INEC is a named party, and the reliefs being sought directly relate to, and could potentially affect the Anambra Central Senatorial District election. 

As of the date of this correspondence, and in addition to the above-referenced case, some of the other pending actions involving INEC are as follows:

1. Case Name: Dr. Obiora Okonkwo v. PDP & Ors.

Suit No: FHC/ABJ/1092/2014

Court: Federal High Court, Abuja.

2.        Case Name: Comrade Anayo Nweke v INEC.

Suit No: FHC/AWK/CS/69/2016

Court: Federal High Court, Awka.

3. Case Name: PDP & Anor v. Chief (Sir) Victor Umeh, OFR & 11 Ors    

Appeal No: SC/204/2016

Court: Supreme Court of Nigeria

4.  Case Name: Chief (Sir) Victor Umeh v  PDP

Appeal No: CA/A/160/2016

Court: Court of Appeal

5.  Case Name: INEC v Peoples Democratic Party

Appeal No: CA/A/165/2016

Court:  Court of Appeal

6. Case Name: All Progressive Congress&ANOR Vs INEC

Appeal No: CA/A/314/2017

As is clearly evident from the above listed cases, INEC is a named party in all the matters and would be directly bound by the decisions of the respective Courts.  

It would therefore be inappropriate to preempt the decision of the Courts in these cases by proceeding with any election prior to a final determination of these actions.

This would invariably result in a situation where INEC, through its conduct, will be foisting a Fait Accompli on the courts and rendering the court judgments nugatory.

Consequently, in light of the foregoing, and given INEC’s constitutional responsibility to determine the timing and conduct of general elections, we hereby respectfully request that INEC hold off on scheduling any elections in Anambra Central Senatorial District pending the determination of these lawsuits. 

To do otherwise would be to create a situation whereby INEC, an agency of the Federal Government, would be perceived as impugning the jurisdiction of the courts of the Federal Republic of Nigeria by foisting a situation of helplessness on the courts.

PDP has been disqualified.

These are names of the candidates that participated in the election on March 28, 2015.
