The Adamawa State High Court sitting in Yola has dismissed a suit seeking to nullify the governorship election held in the state on March 9.
The candidate of the Movement for the Restoration and Defence of Democracy (MRDD), Rev Eric Theman had dragged the Independent national Electoral Commission [INEC] to court.
Rev. Theman alleged that he was deprived the right to be voted for in the March 9 election because the logo of his party was not on the ballot paper.
This, according to him, is despite the fact that he was recognised as a gubernatorial candidate in the March 9 elections.
Ruling, the presiding judge, Justice Abdulaziz Waziri stated that the plaintiff tendered documents not properly certified.
Justice Waziri also faulted the trial because the plaintiff failed to prove his case by not tendering a document that was vital for the determination of the case.
The judge further noted that the plaintiff failed to tender the ballot paper that showed that the logo of his party was omitted.
Speaking about the ballot paper, he said: “The fundamental document that would have proved the point was never brought before this court.
“The burden of proof lies on the plaintiff. This burden was not properly discharged.”
Justice Waziri advised him or any other party wishing to appeal the judgement to do so within 90 days at the Yola Division of the Court of Appeal.
Meanwhile, the Independent National Electoral Commission [INEC] has declared Umaru Fintiri winner of the state election.
Fintiri was declared winner after the supplementary election which held on Thursday.
The Returning Officer of the election, Prof. Andrew Haruna declared the result in Yola after the supplementary election in 44 units across 14 local government areas of the state.
Haruna said Fintiri polled 376,552 votes to beat his closest rival, Gov. Muhammadu Bindow of the All Progressives COngress [APC] who scored 336,386 votes.
