
All indications are that the Supreme Court is poised to rule in favour of the All Progressives Grand Alliance [APGA], Chief Victor Umeh against ousted Senator Uche Ekwunife.
Lawyers for both Chief Victor Umeh and Senator Uche Ekwunife presented their arguments before Justice Tanko Abubakar-led 5-man judges.
MrIkwueto (SAN) standing for Chief Umeh argued that National Assembly matters end at the appeal court and therefore prayed the court not to entertain the case filed by Uche Ekwunife.
Ekwunife’s lawyer, Dr Alex Izinyon (SAN) maintained that the judgement that sacked Uche Ekwunife from the appeal based their reason on primaries which was a pre-election matter.
The learned jury read the documents before them from where the case came to them and found out that it was an election matter.
The matter was determined at the tribunal and court of appeal (special court for election matters) and not from regular courts (High Court and Appeal Court).
That alone settled the case.
They wanted to give the judgement immediately but to give Iyom who was downcast all through the court session smooth landing, they court closed their hearing and fixed Feb 10 ,2017 for judgement.
The Independent National Electoral Commission [INEC], which was a party to the suit, prayed the court to:
1. Sustain the preliminary objection
2. Strike out Uche Ekwunife’s appeal for lacking substance.
Ship sinking PDP went to Federal high court and prayed the court to replace Uche Ekwunife for she was no longer their candidate and the court ruled in their favour.
The same PDP was in Supreme Court asking the court to return Uche Ekwunife to Abuja whom they said was no longer their candidate and Ekwunife.
It’s on record that Ekwunife didn’t appeal the Federal High Court ruling which reveals inconsistency on the part of the ship sinking PDP.
All the efforts made by press men to interview Uche Ekwunife were unsuccessful.
She left the court murmuring, facing the ground, speaking to herself in a low tone, walking depressed and confused.
She forcefully opened her door and left in a manner that seemed that she had been duped.
The only words I heard her say as she left was “I will not go and Umeh will not go”
That shows she has already accepted defeat but to say that Umeh will not go is best described by William Shakespeare who always said “Sound and fury signifying nothing”
