Judge refuses to vacate Ikpeazu sack order
*My enrollment order not enforceable, says Justice Abang
The Federal High Court has refused to set aside order sacking the embattled Abia State governor, Okezie Ikpeazu.
It could be recalled that Governor Ikpeazu was sacked by an Abuja High Court over some tax clearance saga.
The presiding judge had also ordered that Mr. Uche Ogah be issued Certificate of Return in his stead be the Independent national Election Commission [INEC].
Judge of the federal high court, Abuja, Justice Okon Abang insisted that he will not set aside his previous order removing Okezie Ikpeazu as governor of Abia state.
Ikpeazu, through Wole Olanipekun (SAN), had filed an application asking the court to vacate the order.
However, during the ruling on Monday, Abang said that he would not set aside the order, but that he would hear other applications on the matter on Thursday.
That means that Governor Ikpeazu, will remain in office as governor of the state, pending the conclusion of matters in courts.
Abang, thereafter, adjourned hearing to Thursday, 7th July, on the application for Stay of execution by Governor Ikpeazu against his ruling in favour of Uche Ogah.
Justice Abang further said that the enrollment order he gave to uche Ogah was not an enforceable order.
He also adjourned ruling on Ogah’s application seeking to vacate the order by Justice Chibuzo Ahuchaogu of Abia State High Court, that restrained the Chief Judge of Abia State from swearing him in.
