The election petition tribunal sitting in Enugu State, has struck out the suit by the governorship candidate of the Labour Party—LP, Mr Chijioke Edeoga which alleged that Mr Peter Mbah of the Peoples Democratic Party—PDP, forged his National Youth Service Corps—NYSC certificate.
Also, the Tribunal dismissed all the evidence by the DSS, NYSC official and others because they weren’t in tandem with paragraph 4, subsection 5D of the evidence act. Only the witness of pw26 was admitted.
Justice Kudirat Murayo Akano headed tribunal, ruled that NYSC is not a requirement for contesting for the office of the governor and there is nowhere that the NYSC certificate was attached to the documents Mbah submitted and was not deposed to in affidavit.
It argued that it must be proven that the forgery was carried out to circumvent the provisions of the constitution on the qualification of the respondent.
The tribunal also ruled that Mbah was still qualified to stand for the election without the NYSC certificate.
The Evidence of PW1, PW2, PW3, PW30, DW2 and DW4 struck out on the ground they were subpoenaed witnesses.
