Labour leaders reject Tinubu’s unconstitutional removal of Fubara

The Nigeria Labour Congress (NLC) and the Trade Union Congress (TUC) have condemned President Bola Tinubu’s State of Emergency in Rivers State.
In a joint statement, NLC President Joe Ajaero and TUC President Festus Osifo described the president’s action as unconstitutional and undemocratic.
Diaspora digital media (DDM) gathered that they criticized the suspension of elected officials, including Governor Siminalayi Fubara and his deputy, as an abuse of executive power.
The labour leaders argued that suspending Fubara, his deputy, and state lawmakers undermines democracy and Nigeria’s constitutional system.
They cited Part II of Section 305 of the amended Constitution, which outlines conditions for declaring a State of Emergency.
According to them, Tinubu’s decision disregards these legal provisions and violates the principles of Nigeria’s democratic system.
They insisted that the president’s action threatens the autonomy of sub-national governments and the stability of Nigeria’s federal structure.
The NLC and TUC demanded an immediate reversal of the State of Emergency to restore constitutional governance in Rivers State.
They emphasized that Section 305(6) of the Constitution defines the proper legal process for declaring and maintaining a State of Emergency.
Failure to follow this process, they warned, renders the declaration illegal and sets a dangerous precedent for governance.
They argued that no democracy can function if elected leaders are arbitrarily removed at the president’s discretion.
“This reckless move should concern every citizen and governor who values democracy and the rule of law,” their statement read.
They urged President Tinubu to respect constitutional limits and exercise executive power in a lawful and transparent manner.
Leadership, they stated, should inspire confidence rather than create suspicion or fear of executive overreach.
The labour leaders warned that undemocratic actions by the federal government could severely impact governance at all levels.
They noted that such interference could also negatively affect the welfare of workers in Rivers State and across Nigeria.
The NLC and TUC reaffirmed their commitment to resisting any attempts to undermine democratic governance and constitutional order.
They stressed that organised labour would not remain silent in the face of actions that threaten Nigeria’s democracy.
The leaders insisted that the rule of law must be upheld to prevent further executive overreach in the future.
They called on Nigerians to remain vigilant and demand accountability from those in power.
