Meanwhile, Ochudo Martin Agbaso side of APGA was represented by a junior Lawyer not up to 5yrs in the Bar!
There were three prayers on ground which the SANs presented before the appeal court.
1. Stay of Execution on the judgement of the high court pending the determination of the appeal.
2. Injunction restraining Agbaso from Parading himself as National Chairman of APGA.
3. Application on joinder to join Victor Oye as a necessary party base on the suit before the appellate court.
The junior lawyer representing Agbaso opposed the three prayers presented by the SANs.
The young lawyer was so bold, fearless and full of confidence of what he is doing.
The court after listening to the prayers of the SANs and argument of both parties;
i. Refused to grant two out of the three prayers of the appellant that came with SANs.
ii. Granted only one of the prayers which is on joinder of parties.
The junior lawyer after the judgement decided that he will appeal to supreme court on the court of appeal judgement on joining Victor Oye in the suit as necessary party.
With this, did you learn something?
To be a SAN is fantastic and makes you earn higher but doesn’t mean that being a SAN puts you on the best and better advantage of having something upstairs better off than the non-SAN.
Facing a SAN in a court is not a sure bet of you losing your matter, that with boldness, intellectual and procedural game play, you can slog it out with a SAN or anybody.
What wins a case is sound argument and not post in the profession.
Never feel inferior as a young lawyer simply because you are to face a SAN.
Young Lawyers are more updated on the current provisions and positions of the law on facts in issues.
Is a matter of intellect and not matter of SANship.
Many big men these days settles for young lawyers that will give them what they want on a better affordable charge than some SANs that will keep them permanent to feed their pocket and firm.
Don’t limit what you can do as a young lawyer but explore your channels.
The event that took place in the court of Appeal Enugu Division should send a professional message to young lawyers because we all are ministers in the temple of justice.
It is a matter of boldness, smartness and intellect and not matter of post.
