Osun Government addresses court rulings on LG elections
Osogbo, February 10, 2025 –The Osun State Government, through a press release from Honourable Commissioner Oluomo Kolapo Alimi, addressed recent court rulings regarding the local government election.
Furthermore, the government reaffirmed its commitment to maintaining peace and order in the state before the upcoming elections on February 22, 2025.
The Commissioner highlighted today’s Court of Appeal judgment, which dismissed the originating summons filed by the People’s Democratic Party (PDP).
Notably, the PDP sought to challenge the validity of the October 2022 election, but it filed its case prematurely.
Consequently, the court ruled that the PDP never had a valid case to contest the election.
However, Oluomo Alimi clarified that another legal challenge remains relevant. The Action Peoples Party (APP) had filed a separate suit questioning the legality of the same election.
In its judgment on November 30, 2022, the Federal High Court in Osogbo nullified the October 15, 2022 election.
The court cited constitutional violations and breaches of the Electoral Act 2022 in its decision.
Specifically, the court declared the election unconstitutional. This declaration stemmed from non-compliance with sections 28, 29, 32, 98, and 150 of the Electoral Act.
The Federal High Court also issued consequential orders, including:
1. Declaring the October 15, 2022 election null and void.
2. Sacking all individuals occupying local government offices as a result of the election.
3. Striking down sections of the OSSIEC Law 2022 that were inconsistent with constitutional provisions and the Electoral Act 2022.
The ruling made by the Federal High Court was subsequently appealed, leading to Case No. CA/AK/226M/2024.
On January 13, 2025, the Court of Appeal affirmed the Federal High Court’s judgement, solidifying its legal standing.
In light of these developments, the Osun State Government emphasized that the only valid judgement currently in effect remains the Federal High Court’s order nullifying the October 15, 2022 election.
Therefore, there is no legal basis for reinstating any local government chairpersons or officials who assumed office following that election.
The Honourable Commissioner urged security operatives and Heads of Local Government Administrations (HLAs) to remain vigilant and ensure that no unauthorized individuals attempt to disrupt peace or unlawfully occupy local government offices.
He called on security agencies to arrest and prosecute anyone attempting to destabilize the state or interfere with local government operations.
Additionally, Oluomo Alimi advised HLAs to prevent intruders or political thugs from gaining access to council premises. Any attempts to breach security at council secretariats should be promptly reported to law enforcement authorities.
Finally, the Commissioner reassured citizens that preparations for the upcoming local government election on February 22, 2025, are on track. He expressed confidence that barring any unforeseen circumstances, the election will proceed as scheduled.
