Why the US intervened in South Africa’s genocide case against Israel

(DDM) – The United States has formally intervened in the genocide case brought by South Africa against Israel at the International Court of Justice (ICJ) in The Hague, marking a significant development in one of the most closely watched legal disputes arising from the war in Gaza.

The case centers on whether Israel’s military operations in Gaza following the October 7, 2023 attack led by Hamas amount to genocide under the 1948 Genocide Convention.

What the case is about

South Africa filed the lawsuit at the ICJ, arguing that Israel’s actions during its military campaign in Gaza constitute genocide against Palestinians.

Pretoria’s legal argument relies on provisions within the 1948 Genocide Convention, which defines genocide as acts committed with the intent to destroy, in whole or in part, a national, ethnic, racial, or religious group.

Israel has strongly rejected the allegation.
