BREAKING: Supreme Court throws out Atiku’s appeal against Tinubu’s election

The Supreme Court has dismissed the appeal by Peoples Democratic Party (PDP) presidential candidate, Atiku Abubakar against the September 6 judgment of the Presidential Election Petition Court (PEPC), affirming the election of the All Progressives Congress (APC) presidential candidate, Bola Ahmed Tinubu.

In the lead judgment read by Justice John Okoro, which has so far been supported by Justices Uwani Abba-Aji and Mohammed Garba Lawal, the court resolved all the seven issues identified for determination against the appellants.

The court upheld the judgment of the PEPC and proceeded to affirm Tinubu’s victory.

The apex court had ruled, amongst other things, that the failure of the Independent National Electoral Commission (INEC) to transmit the election results on the INEC Result Viewing Portal did not affect the outcome of the presidential election.

Reading the lead judgment, Okoro said, “When IReV fails, it does not stop the collation of the results.

“It deprives people of viewing results. The nonfunction will affect the trust of the electorates in the election.

“Unavailability of IReV cannot be a ground for the election to be nullified.

“The failure did not affect the outcome of the election. The issue is resolved against the appellants. “
