Trump seeks delay in sentencing, cites immunity ruling amid inauguration countdown

United States President-elect Donald Trump’s legal team has filed a motion to delay the sentencing in his hush money trial, which is currently scheduled for January 10, just days before his inauguration.

The motion argues that the sentencing is unlawful, invoking a recent Supreme Court decision on immunity, the state constitution of New York, and other legal precedents.

The legal team contends that the Supreme Court’s historic ruling on presidential immunity should shield Trump from facing sentencing at this time.

According to the defense, the decision on immunity, combined with New York state constitutional provisions, strengthens the argument that Trump should not face any legal consequences before his inauguration.

Trump’s spokesperson, Steven Cheung, provided a statement on Monday to CBS News, describing the case as part of an ongoing political attack against the president-elect.

From the information made available to Diaspora digital media(DDM), Cheung expressed that Trump’s return to the White House requires an immediate end to what he called the political weaponization of the justice system.

In his statement, he also referred to the remaining legal battles Trump faces as “Witch Hunts,” alluding to the multiple investigations that have dogged him since his time in office.

“The Supreme Court’s historic decision on Immunity, the state constitution of New York, and other established legal precedents mandate that this meritless hoax be immediately dismissed,” Cheung said, referring to the hush money case as a “hoax.”

Trump was convicted in May of 2023 on 34 counts of falsifying business records.

These charges stem from a $130,000 payment made to former adult film actress Stormy Daniels.

The payment was intended to silence Daniels’ allegations of an affair with Trump in 2006, just ahead of the 2016 presidential election.

The sentencing for Trump is set to take place at 9:30 a.m. on January 10, 2025.

This date falls just ten days before Trump is scheduled to be inaugurated for his second term as president, adding further tension to the legal proceedings.

While Trump’s legal team seeks the delay, the court has yet to issue a decision on whether to grant the motion.
