Court: Justice Tsoho, don return Kanu case back to Justice Nyako

Di Oga Judge of di Federal High Court, Abuja, wey bi Justice John Tsoho, don on October 11, 2024, go return Mr. Nnamdi Kanu case file back to Justice Binta Nyako, afta she bin try to step aside for di case on September 24.

According to di tori on News Agency of Nigeria (NAN), wey carry October 11 date, Judge Tsoho don go return Mr. Kanu case file give to Justice Binta Nyako.

But tori dey come from inside Federal High Court say di Chief Judge don change mind, return Nnamdi Kanu case file back to Justice Binta Nyako.

Justice Tsoho be di Chief Judge of di Federal High Court, and him get reputation for being fair and firm

Mr. Kanu na di leader of Indigenous People of Biafra (IPOB) wey Federal Government dey prosecute.

So, di case go continue dey go on, but dis time e go bi under Justice Nyako.

Kanu go still dey face trial for di seven-count terrorism charge wey Federal Government bring against am.

But according to one trusted pesin wey dey inside Federal High Court com leak di tori to NAN, e say the chief judge don cancel Justice Nyako’s withdrawal from di case.

Meaning say Justice Nyako go continue dey handle IPOB Oga trial, afta all.

Justice Tsoho say make IPOB Oga formally tell court say him no wan make Justice Nyako handle him case.

IPOB Oga lawyer must to go to court, write motion on notice, and explain why di leader of IPOB no wan stand trial before Justice Nyako.

Dem dey expect say di leader of IPOB and im lawyer go serve Federal Government, through di office of di Attorney-General, copy of di motion, make dem respond.

Both sides go talk dia own for court, and di judge go decide wetin go happen.

NAN com dey remind us say Justice Ahmed Mohammed and Justice Tsoho (before him become Chief Judge) bin dey handle Nnamdi Kanu’s case before dem give am to Justice Nyako.

Why dem give am to Justice Nyako?

So, di leader of IPOB trial don pass through different judges hand, and now Justice Nyako dey handle am.

But before, Justice Ahmed Mohammed and Justice Tsoho bin try to handle am, but Kanu no gree.

Last time dem adjourn di case, Federal Government lawyer, Mr. Adegboyega Awomolo SAN, tell court say dem ready to continue Kanu’s trial.

But Kanu’s lawyer, Mr. Aloy Ejimakor, quickly ask court to postpone di trial because dem get two appeals wey dey challenge court’s power to handle di case.

Mr. Ejimakor say dem need time to sort out those appeals before dem continue di trial.

But Mr. Awomolo no agree, say dem no fit stop trial because of di pending appeal, and Ejimakor suppose go file for proceedings at di appellate court.

Na so di mata dey, and Justice Binta Nyako eventually withdraw from di case afta Kanu say him no get confidence in di court again.

Justice Nyako come talk say make dem no dey waste time for di matter, since she don rule say court no go listen to any other application until dem finish di trial.

She want dem to focus on finishing di case, no more delays.

Lawyer Ejimakor talk say no be right to continue trial when him no don prepare Kanu well-well for defence.

Him yarn say him no fit defend Kanu well if dem rush into trial, him need time to prepare ground.

Justice Nyako no gree hear am, instead, her direct say make dem call prosecution witness come testify.

Ejimakor yarn say: “Wetin dem do with court orders? Dem no gree obey am.

Justice Nyako reply: “No time for dat, call di prosecution witness.”

Kanu shout from dock: “Wetin you dey talk? Sit down! No follow me talk again!” Ejimakor just calm down, no know wetin dey enta Kanu mind.

Him vex well-well, and Ejimakor no know wetin do.

Di IPOB leader com dey yarn say Supreme Court don rule say dem no fit violate him fundamental rights, especially wen dem dey stop am from seeing him lawyers.

Him insist say authorities wey dey hold am no suppose stop am from accessing him lawyers, na against di law.

Kanu turn to Justice Nyako, say: “My lord, I no trust dis court again, I beg you, step aside, because you no follow Supreme Court decision.”

“I no get confidence for dis court again, I want you to withdraw from my case since you no respect Supreme Court ruling.”

Nnamdi Kanu yarn say: “Me no mind if DSS no gree obey court order, but for dis court to no obey Supreme Court order, na regrettable thing.

“Make you step aside from my case,” him tell Justice Nyako.

Awomolo counter Ejimakor argument, say Supreme Court judgment wey dem deliver 2023 no support am.

Him say apex court order lower court to continue Kanu’s trial.

Awomolo yarn say Oga Kanu’s claims no match with Supreme Court verdict.

“Dis observation na incompetence and audacity carry am come,” Awomolo talk.

“Di judge talk say, as far as her concern, Supreme Court never support Kanu’s claim.

No be wetin Supreme Court talk, be dat.

Justice Nyako surprise say oga Kanu stand up, shout on him lawyer.

She yarn: “I dey step aside from dis case, and I dey send di file go Chief Judge for further action,” Nyako talk.

Justice Nyako talk say: “Me no fit continue trial where defendant no trust court.”

Awomolo thank Justice Nyako, say: “Na very sad day be dis, na unfortunate day.”

Justice Nyako yarn: “If defendant no trust me, me no fit try am.”

Awomolo reply: “Tanks, My Lord. Dis day be sorrowful day, na real wahala.”
