EU Court Imposes Hefty Fine on Hungary Over Asylum Policy Breach

In a landmark ruling, the European Court of Justice has ordered Hungary to pay a substantial fine of €200 million (approximately $216 million) for failing to comply with the European Union’s asylum policies.

The court also imposed a daily penalty of €1 million until Hungary brings its asylum procedures in line with EU law.

The ruling is a culmination of a legal battle that began in December 2020, when the court ruled that Hungary’s procedures for granting international protection and returning third-country nationals were in breach of EU law. Despite the earlier judgment, Hungary has failed to implement the necessary changes, prompting the court to impose the hefty fine.

According to the court statement, Hungary’s failure to comply with the 2020 judgment constitutes “an unprecedented and extremely serious infringement of EU law.” The judges noted that Hungary has not taken the necessary measures to ensure access to international protection procedures, including the right of applicants to remain in Hungary pending a final decision on their appeal.

This ruling highlights the EU’s commitment to upholding its values and principles, particularly in the area of asylum and migration. The court’s decision sends a strong message to member states that they must adhere to EU law and respect the rights of asylum seekers.
