EFFURUN, DELTA — High Court 2 sitting in Effurun, Delta State, has discharged two minors previously accused of rape after ruling that the prosecution failed to diligently pursue the case.
The decision was delivered on Tuesday, April 21, 2026, at approximately 11:20 a.m., at the Effurun High Court, where the matter was struck out due to lapses in the handling of the case by the Nigerian Police Force, Warri Area Command.
The minors were initially arraigned on December 9, 2025, through a motion ex parte filed by the police. On the same day, the court granted them bail after defence counsel raised objections based on provisions of the Administration of Criminal Justice Law (ACJL) of Delta State and the Child Rights Law.
According to defence counsel, Agba Abraham, the prosecution failed to effectively follow through with the case, leading to prolonged delays and lack of substantive progress in court proceedings.
The judge, in striking out the matter, held that the inability of the prosecution to diligently prosecute the case made it unsustainable to continue the trial. The ruling effectively brought the case to an end.
With the court’s decision, the two minors have now been formally discharged and are no longer facing any criminal charges in relation to the allegations.
