Labour party caretaker committee responds to misleading appeal court statement

Labour Party Caretaker Committee, led by Senator Nenadi Usman, has issued a statement correcting a misrepresentation made by Barrister Julius Abure regarding the Appeal Court ruling delivered on January 17, 2025, concerning the ongoing leadership dispute within the party.

Diaspora digital media (DDM) gathered that Barrister Julius Abure, who heads the Labour Party’s National Working Committee (NWC), had claimed in a media statement that the Appeal Court, presided over by Justice Emeka Nwite in Abuja, had reaffirmed his position as the National Chairman of the Labour Party.

This claim, according to the Caretaker Committee, was a gross misinterpretation of the court’s judgment.

In a press release jointly signed by Senator Nenadi Usman, the Caretaker Committee’s Chairman, and Senator Darlington Nwaokocha, the Secretary, the Labour Party Caretaker Committee set the record straight.

They emphasized that the Court of Appeal, Abuja Division, in its ruling on Appeal No: CA/ABJ/CV/1217/2024, SEN. NENADI ESTHER USMAN & ANOR v. LABOUR PARTY & ANOR, ruled in favor of their appeal, challenging the earlier judgment of the Federal High Court delivered on October 8, 2024, in Suit No: FHC/ABJ/CS/1271/2024.

The Caretaker Committee pointed out that the Federal High Court had wrongly entertained the leadership dispute, as the matter was beyond its jurisdiction.

“The judgment delivered by the Court of Appeal confirmed that the Federal High Court had no jurisdiction over the leadership dispute filed by Barrister Julius Abure,” the statement clarified.

The Caretaker Committee also noted that the Federal High Court had overstepped its bounds by considering the case, which it argued was non-justiciable.

The statement further criticized the Federal High Court’s failure to properly consider the Counter-Affidavit filed by the Caretaker Committee in opposition to the suit.

According to the Caretaker Committee, the court’s oversight violated their right to a fair hearing.

In addition to addressing the Federal High Court’s handling of the case, the Caretaker Committee also responded to what it described as an “erroneous and unsolicited finding” by the Court of Appeal.

This finding, delivered on November 13, 2024, in Appeal No: CA/ABJ/CV/1172/2024, suggested that Julius Abure had been “admitted as the National Chairman of the Labour Party.”

The Caretaker Committee strongly disagreed with this interpretation, stressing that the judgment referred to an unrelated issue concerning the nomination of a governorship candidate for the Ondo State Governorship Election.

The judgment, they clarified, had no bearing on the leadership dispute at the heart of the current case.

“The finding made by the Court of Appeal in its November 13, 2024 ruling is inconsistent with the substantive judgment delivered by the court,” the Caretaker Committee said in their statement.

They emphasized that the leadership dispute was entirely separate from the Ondo State election matter and should not be conflated.

The Labour Party Caretaker Committee reiterated a key legal principle in Nigeria: that courts do not have jurisdiction over the internal matters of political parties, including leadership disputes.

“We commend the Court of Appeal for affirming that the leadership dispute in Suit No: FHC/ABJ/CS/1271/2024 is non-justiciable and outside the court’s jurisdiction,” the statement read.

In their statement, the Caretaker Committee also sought to remind party members and stakeholders that the Labour Party had legally constituted a National Caretaker Committee on September 4, 2024.

This committee, they stated, appointed Senator Nenadi Usman as Chairman and Senator Darlington Nwaokocha as Secretary, and both have been fulfilling their duties with the full approval of party stakeholders.

The Caretaker Committee also stressed that the leadership dispute initiated by Barrister Julius Abure had no merit and was dismissed by the Court of Appeal.

“As the duly recognized National Caretaker Committee Chairman and Secretary of the Labour Party, we find it necessary to issue this press release to clarify the situation and set the record straight,” they concluded.

The Caretaker Committee’s statement aims to reassure Labour Party members that the ongoing leadership issue has been properly addressed by the courts and that the legitimate leadership of the party is firmly in the hands of the Caretaker Committee.

They also urged party members to disregard any misleading claims about the court ruling and to stand united under the leadership of Senator

Nenadi Usman and Senator Darlington Nwaokocha.
