Supreme Court Overrules Lower Courts in Kano Governor Abba Yusuf’s Case

In a unanimous decision, the five Justices unanimously Disagree with Appeal Court and Election Petitions Judgements.

The Supreme Court has criticized the judgments of the Appeal Court and the Election Petitions that nullified the election of Kano State Governor Abba Yusuf.

The five-member panel of justices, led by Justice Inyang Okoro, found that the lower court misunderstood the significance of the reported deduction of 165,616 ballot papers in favor of Governor Yusuf.

Justice Okoro emphasized that the matter concerning Governor Yusuf’s membership was a pre-election issue. He clarified that the lower court’s observation that Governor Yusuf was not sponsored by the NNPP (New Nigeria Peoples Party) was not a finding of the electoral tribunal but a mere observation that his name was not on the membership list.

The Supreme Court consistently maintained that the nomination or sponsorship of a candidate is solely the prerogative of the political party, according to Justice Okoro. The ruling sets a precedent in the interpretation of election-related matters, providing clarity on the exclusive role of political parties in nominating candidates.
