Supreme Courts upbraids Tribunal, appeal court over decisions, gives Gov Muftwang victory

The Supreme Court, on Friday, was unsparing in its critic of decisions by both the Tribunal and Court of Appeal in the case of the Plateau State governorship election while declaring Caleb Muftang of the Peoples Democratic Party (PDP) as the duly elected Governor of Plateau state.

Delivering the lead judgment, Justice Emmanuel Agim held that the Court of Appeal lacked the jurisdiction to determine the nomination of Muftang as candidate of the PDP in the March 18, governorship election in the State.

The judgement was on an appeal by Muftang challenging the decision of the appellate court which nullified his election, and declared Nentawe Yilwatda, candidate of the All Progressives Congress as Governor.

“This is a thorough misuse of the order of the High Court.

“I wonder why this case came to court.

“The legal profession should wake up, appeal allowed and judgment of the Court of Appeal is set aside.

“Judgment of the Tribunal is restored, the apex court held.

Recall that on March 20, the Independent National Electoral Commission had announced Mutfwang as the winner of the election having scored 525,299 votes, while Nentawe Yilwatda, candidate of the All Progressives Congress (APC) got 481,370 votes.
