Olorundahunsi, Ex-Nigeria’s Supreme Court Registrar & judge accused of contravening public service rules allegedly “disappears” whistleblowers

A former Registrar of the Supreme Court of Nigeria, who is currently a judge at the Ondo State Judicial Division, one Justice Sunday Olorundahunsi, currently standing trial for contravening public service rules, has allegedly “disappeared” the whistleblowers, namely Dr. George Daniel Davidson, Raymond Audu and Adekunle James.

Whistleblowers, under the aegis of Save The Soul Transparency and Eagle Eyes International Foundation, made the accusation in a petition.

The petition, with file number: ST/009/22/24, dated September 16, 2024, was addressed to the Chairman of the National Judicial Commission (NJC) holden at the Supreme Court of Justice, Abuja.

The petition was tagged “SOS -Urgent need to save the lives of our missing agents who are missing and among them Dr George Daniel Davidson , Raymond & James whom we established one Justice Sunday Olorundahunsi- a former Chief Registrar Supreme Court of Justice Nigeria now a High Court judge in Ondo State and CP Abayomi Peter Oladipo Commissioner of Police Ondo State Command for unlawful incarceration, outright extra judicial killing, oppression and flagrant disobedience to a Federal High Court order; desperate attempt to frustrate the cause of justice in Code of Conduct Tribunal CCT/ON//01/24/ FRN VS Justice Sunday Olorundahunsi- and DPPA/COMP/275/24 on gross abuse of office as the Chief Registrar Supreme Court“.

The whistleblowers also alleged that Justice Olorundahunsi pulled off the act in collusion with the Commissioner for Police, Ondo State Command, Mr. Abayomi Peter Oladipo.

Previous report on Olorundahunsi

It could be recalled that Diaspora Digital Media (DDM) reported that the whistleblowers accused Olorundahunsi of owning and running private companies, contrary to public service rules.

The accusation was premised in a petition addressed to the President of the Federal Republic of Nigeria.

The Whistleblowers expressed serious concerns to Mr. President over perceived atrocities and injustice in the judiciary sector, noting that it is “shameful and endless”.

The petitioners, in the petition, cited a letter with reference: DPPA/COMP/275/24, dated 20th June 2024 and addressed to the Chairman of the Code of Conduct Tribunal (CCT).

The petition was tagged CCT/ON/01/24 in a case instituted between the Nigerian Government and Olorundahunsi.

Therein, one MB Abubakar, the Director of Public Prosecutions (DPP) of the Federation in the office of the Attorney General of the Federation asked the CCT Chairman to halt the prosecution of the former Supreme Court Registrar.

The lady of Justice gagged?

The Code of Conduct Bureau was also directed to promptly forward the original case file to the Attorney General’s office.

A copy of the correspondence is herewith attached for ease of reference:

“RE: Case of harassment and intimidation of a judicial officer by Barr. Mrs. Nancy Adenike Ademujimi through the Code of Conduct Tribunal in charge no CCT/ON/01 / 2024.

“This office is in receipt of a petition dated 23rd May 2024 by Prof. Yemi Akinseye-George, SAN & Partners acting as Counsel to Hon. Justice Sunday Idowu Olorundahunsi who is the defendant with respect to the above-mentioned Charge.

“After a careful consideration of the petition and in line with the provisions of Section 174 (1) (b) of the Constitution of the Federal Republic of Nigeria 1999 (as amended), the Honourable Attorney-General of the Federation and Minister of Justice has directed that this office takeover the prosecution of the case.

“I am further directed to request that, in line with Section 105 (3) of the Administration of Criminal Justice Act (ACJA) 2015, you promptly forward the original casefile, which should include all court processes in respect of Charge No: CCT/ON/01/2024 between Federal Republic of Nigeria V. Justice Sunday Olorundahunsi.

“Please accept the assurance of the warm regards of the Honorable Attorney-General of the Federation and Minister of Justice.”

Supreme Court Registrar as CEO of private companies

The petitioners wondered: “How on earth could a judicial staff be CEO of private companies and at the same time be the Registrar in Supreme Court?

“Same Registrar wrote to the Supreme Court as a CEO of companies and responded as the Registrar of Supreme Court to his own companies,” the petition stressed.

The petitioners also accused DPP Director of meddlesomeness in the matter when Olorundahunsi was charged before CCT.

The petition stated: “When charged to the Tribunal for gross misconduct as a sitting Judge, the Director of Public Prosecutions (DPP) of the Federation in the office of the Attorney General of the Federation is interfering?”

Davidson speaks from prison

Dr. Davidson, who is currently remanded in Oluokuta Correctional facility Akure since August 22, 2024, reached out to DDM through his lawyers.

Speaking through his lawyers, he said: “I was arrested on the 30th of July 2024.

“I was brought in from Abuja to Ondo state Command of NPF Kept in detention from 30th July to 12th August and was taken to Magistrate ll T.G. Alphonso @ Oke -Eda new extension.

“The Magistrate kept me in Oluokuta Correctional facility Akure from 22 August 2024 till date.

“I got to court on the 26th 2024 from the prison and the prosecutor informed the Magistrate Court that they have filed a charge in the Akure high court and that she has no jurisdiction over the case since a charge is before a High Court but no date.

“It is also not assigned to any specific date. All these are strategies to keep me in detention indefinitely.

“The allegations, as claimed, are cyber stalking in nature which is the exclusive of the Federal High Court.

“Why then the indefinite incarceration?

“CP Abayomi Peter Oladipo, a blossom friend of Justice Sunday, told me that he can’t take me to his fathers as a court when I demanded for the instrument that he used to detain me during the National Industrial protest 1-10 August, 2024.”

Davidson sues Olorundahunsi, others for human rights violation

In the meantime, Davidson has dragged the matter to court for the enforcement of his fundamental human rights.

The case was brought before the presiding judge, Hon. Justice Peter 0. Lifu in the Federal High Court of Nigeria in the Abuja Judicial Division, suit no: FHC/ABJ/CS/1150/2024.

Davidson prayed the court to enforce his fundamental rights to personal liberty and dignity of human persons as enshrined in the Constitution of the Federal Republic of Nigeria 1999 As Amended.

The matter, which has Dr. George Daniel Davidson as the applicant, has the Nigerian Police, Inspector General of Police, Ondo State Commissioner of Police, the Assistant Inspector General of Police, Zone 7 and Olorundahunsi as respondents.

Prayers

Upon the originating motion dated and filed on August 09, 2024, the applicant prayed for the following reliefs:

  1. A Declaration that the Applicant was arrested and detained by the Respondents based on an allegation of committing the offence of Cyberbullying and Harassment of the Respondent since the 30th day of July 2024 and later transferred to the custody of the 30 Respondent.
  2. A Declaration that the arrest and detention of the Applicant without any charge or bail since the 30th day of July 2024 is unlawful, illegal, malicious and unconstitutional.
  3. A Declaration that the Applicant is entitled to his right to personal liberty freedom of movement and dignity of their human persons as guaranteed and enshrined in Sections 34, 35 and 41 of the 1999Constitution and Articles 5, 6, and 14 of the African Charter on Human and Peoples Rights.
  4. An Order of this Honourable Court compelling the Respondents to immediately release the Applicant from their custody or arraigning him before a court of competent jurisdiction.
  5. An Order of Perpetual Injunction Restraining the Respondents and/or their agents from further arresting and/or detaining the Applicant.
  1. The sum of N10,000,000.00 (Ten Millon Naira) as damages to the Applicant for the unlawful and unwarranted infringement by the Respondents of his rights to freedom of movement, personal liberty and human dignity.

After hearing J. A. Ogenyi Esq. of counsel for the Applicant, the judge ordered the Respondents to, within seven days, produce the Applicant dead or alive in the court unfailingly.

Justice Lifu, alternatively, ordered that Davidson be release on bail to his lawyer who shall undertake to produce him in Court on any adjourned date.

When a judge disobeys court order

Reacting to the order of the Abuja High Court, the Legal/Prosecution Section of the Nigeria Police, in a letter tagged CB: 3960/X/LEG/FHQ/ABJ/VOL.26689, and dated 9th September 2024, directed the Assistant Inspector-General of Police at Zone 7 Headquarters to comply with the order.

The letter entitled “RE: suit no. FHC/ABJ/CS/1150/2024 Dr. George Daniel Davidson and Nigerian Police Force & 4 Ors“, reads:

“I forward herewith a copy of Order received from the Federal High Court Abuja on the above-mentioned case.

“The Commissioner of Police Legal Section, FCID, Abuja humbly requests the Assistant Inspector General of Police to direct the officer in charge of the legal section to treat, please.”

However, as at the date of this publication, Davidson has yet to be granted bail or produced in Abuja court in clear violation of the order of the court.

DDM learnt that it was in view of these developments that the whistleblowers approached the National Judicial Commission Chairman, asking him to “save the lives of our missing agents who are missing, and among them Dr. George Daniel Davidson, Raymond and James”.

Whistleblowers alleges “disappearance” of agents by Olorundahunsi

The petition written by Save The Soul Transparency and Eagle Eyes International Foundation, is hereby produced in full below:

Sir,

SOS -Urgent need to save the lives of our missing agents who are missing and among them Dr George Daniel Davidson , Raymond & James whom we established one Justice Sunday Olorundahunsi- a former Chief Registrar Supreme Court of Justice Nigeria now a High Court judge in Ondo State and CP Abayomi Peter Oladipo Commissioner of Police Ondo State Command for unlawful incarceration, outright extra judicial killing, oppression and flagrant disobedience to a Federal High Court order; desperate attempt to frustrate the cause of justice in Code of Conduct Tribunal CCT/ON//01/24/ FRN VS Justice Sunday Olorundahunsi- and DPPA/COMP/275/24 on gross abuse of office as the Chief Registrar Supreme Court.

Above subject matter ref. BACKGROUND: We are a non-governmental organization (NGO) saddled with the responsibilities to expose corruption at every sphere of human endeavors amongst other responsibilities.

Olorundahunsi’s antecedents

We are aware and certain that Justice Sunday OLORUDANHUNSI-was a former Chief Registrar at Supreme Court of Justice Nigeria. We are also aware that CP Abayomi Peter Oladipo the Commissioner of Police, Ondo state Command is his bosom friend and they shared accommodation in Abuja at different time.

We are also certain that the said Justice Sunday Olorundahunsi-as the Chief Registrar at Supreme Court of Justice Nigeria, did register a private company where he is the Managing Director/CEO of the Estate management company. We are certain that the said Justice Sunday Olorundahunsi-as the then Registrar wrote correspondences to himself as the Registrar of Supreme Court of Justice Nigeria from his private company as a CEO/MD, urging staff of supreme court of Justice Nigeria to subscribe into his private estate management company and replied himself as chief Registrar of the supreme court of Justice Nigeria acknowledging the correspondences from his private estate management company.

We know for a fact that he, Justice Sunday Olorundahunsi-as the then Chief Registrar of Supreme Court abused the 5th Schedule of the Code of Conduct Bureau: Reference CCT/ON/01/24 FRN vs. Olorundahunsi and attached correspondences from DPPA/COMP/275/24 Annexture A” a correspondence from Director Public Prosecution (DPPA) Federal Ministry of Justice Abuja.

We are very certain that the then Chief Registrar of Supreme Court of Justice Nigeria now Justice Sunday Olorundahunsi and the wife were the sole signatories to the private estate management company and the wife is a staff of National Industrial Court of Nigeria (NICN) and was in Headquarters Abuja office then but currently in the Ondo state office. The then Chief Registrar of Supreme Court of Justice Nigeria Mr Sunday Olorundahunsi as duped one Nancy Adejimi Adejike Esq in the cause of him operating the private company.

July 2024

Justice Sunday Olorundahunsi-as was to be arranged before the Chairman Code of Conduct Tribunal (CCT) by the Code of Conduct Bureau (CCB) but for the speculation of the appointment of a new Chairman of CCT. The case is pending as we write.

Curiously, but in a very desperate moves, Justice Sunday Olorundahunsi has employed the service of his childhood friend, Commissioner of Police Ondo State, Mr Abayomi Peter Oladipo to come to Abuja and arrest our agents which we learnt two of them are dead in the Police cell at Ondo state and they are currently holding our agent Dr George Daniel Davidson in Ondo state Command since July 30th, 2024. He was taken from Abuja to Ondo by the Commissioner of Police Ondo state Command Abayomi Peter Oladipo and his men.

Two whistleblowers killed by policemen in the Custody?

We are informed two [of] our research agents were killed by the policemen in the Custody in Akure. We attached here a court Order from Justice Peter Lifu Federal High court Abuja to produce Dr George Daniel Davidson whom he alleged of Cyber Stalking, Defamation and threat to and he flagrantly refused to obey but using a magistrate court Order from Magistrate T.G. Alphonso, at Oke Eda new extension Akure to incarcerate our agent for 3 months now over an allegation that are ordinarily Bailable offences in our legal justice system if at all there was any offence(s). Dr George Daniel Davidson is said to be currently at Oluokuta Correctional facility, Akure Ondo state on the order of the Commissioner of Police Ondo State Command Abayomi Peter Oladipo.

Dr George Daniel Davidson has a surgery to embark on but Mr. Sunday Olorundahunsi and CP Abayomi Peter Oladipo want him dead to cover up Justice Sunday’s crimes as his perceival of Dr George Daniel Davidson as his enemy over his gross abuses of office while he was the Chief Registrar, Supreme Court of Justice, Nigeria.

Justice Lifu Peter Federal High court Abuja: he gave an Order that Dr George Daniel Davidson be handed over to his lawyer but till date, the CP Abayomi Peter Oladipo refused to honor the Order. We perceived that like the other two agents, Dr George Daniel Davidson might have been dead too, otherwise, we wondered why the NPF won’t obey the court Order that has been served on them both at the Inspector General of Police office and the Commissioner of Police Ondo state Command still, they refused to honor the Order.

Questions

We ask the following questions:

Where is Raymond Audu, Adekunle James and Dr George Daniel Davidson? Are they dead in the hands of Justice Sunday OLORUDANHUNSI-as employed by CP Abayomi Peter Oladipo?

Why did the NPF refuse to produce Dr George Daniel Davidson in court? Is the practice of law in Nigeria not one? We attached to this petition the following documents:

1. Copy of petition to the IGP-NPF

2. Copy of the court Order from the Federal High Court Abuja

3. A memo from DPPA to CCT Chairman

These documents will guide your investigation into the hidden agenda of Justice Sunday Olorudanhunsi-as and CP Abayomi Peter Oladipo to hide our agents in Akure in order to prevent holistic investigation over his unethical practices as a public servant alongside his wife.

We pray your office to intervene in these desperate circumstances Justice Sunday Olorudanhunsi has plunged himself. There persons are missing and all fingers point to him.

Prayers:

1. Dr George Daniel Davidson, Raymond and Mr. James be released with immediate effect if they are still alive.

2. An urgent discreet investigation be conducted why a scared office of this magnitude would get involved in dealings like this.

3. Justice Sunday Olorudanhunsi and CP Abayomi Peter Oladipo should obey the court Order if DR George Daniel Davidson is still alive or either way.

DDM reached out to Sunday Olorundahunsi for his reaction to the weighty allegations levelled against him but, similar to the first report, he failed to respond almost 48 hours later till about the moment of this publication.
